NOTICE OF COMPLETE APPLICATION AND NOTICE OF PUBLIC MEETING CONCERNING A PROPOSED ZONING BY-LAW AMENDMENT, FILE NO. Z-2015-09

TAKE NOTICE that the City of Timmins received a complete application from Anna Annala (Agent:  Barry H. Martin) for a proposed Zoning By-law Amendment in 2015.  A statutory public meeting was held on August 24, 2015, to gather public input regarding the proposed Zoning By-law Amendment.  Since then, there has been a change in land ownership and the application did not move forward.  The current owner has requested the application now be brought back for consideration by the City of Timmins Council.   A second public meeting will be held as part of the process, therefore:

TAKE NOTICE that the Council of the Corporation of the City of Timmins will hold a second public meeting on Tuesday, July, 24, 2018, at 4:00 p.m. in the Council Chambers, 220 Algonquin Boulevard East, Timmins, to gather public input regarding a proposed Zoning By-law Amendment under Section 34 of the Planning Act, R.S.O 1990, c. P. 13, as amended.

Location:         Concession 4, Part of Lot 12, Registered Plan 6R3960, Parts 2 and 3, Part of Part 1, Registered Plan 6R8920, Part 1, Parcel 8087, Township of Whitney, City of Timmins

THE PURPOSE AND EFFECT of the proposed Zoning By-law Amendment is as follows:

The lands are currently zoned as Rural (RD-RU).  The applicant proposes to rezone the subject lands to Residential First Density (NA-R1), Residential Medium Density 2 (NA-RM2) and Residential Medium Density 1 (NA-RM1) to facilitate a plan of subdivision with 40 lots comprising the following:

  • Lots 1 to 38 to be zoned Residential First Density (NA-R1) which would permit single detached residential dwellings;
  • Lot 39 to be zoned Residential Medium Density 2 (NA-RM2) which would permit an apartment, multiple dwelling, row or townhouse development;
  • Lot 40 to be zoned Residential Medium Density 1 (NA-RM1) which would permit a four-plex, row or townhouse development.

At this time the City of Timmins is not in receipt of an application for a plan of subdivision under the Planning Act, R.S.O. 1990 c. P.13, pertaining to the subject lands.

ANY PERSON may attend the public meeting and/or make written or verbal representation either in support of or in opposition to the proposed Zoning By-law Amendment.

If a person or public body would otherwise have an ability to appeal the decision of Council of the City of Timmins to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of Timmins before the by-law is passed, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the City of Timmins before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

The subject land was the subject of an application under the Planning Act, R.S.O 1990, c. P. 13 for a consent, File No. B-04-16.
