NOTICE OF COMPLETE APPLICATION AND PUBLIC MEETING RE: PROPOSED ZONING BY-LAW AMENDMENT

TAKE NOTICE that the Council of the Corporation of the City of Timmins will hold a public meeting on Monday, November 24, 2025, at 3:00 p.m. in the Council Chambers, City of Timmins, 220 Algonquin Boulevard East, Timmins, Ontario, to gather public input regarding a proposed Zoning By-law Amendment under Section 34 of the Planning Act, R.S.O 1990, c. P. 13, as amended.

THE PURPOSE AND EFFECT of the proposed Zoning By-law Amendment is to rezone a portion of the subject land currently zoned Residential Estate Type 2 (RD-RE2) to Residential Estate Type 2 (RD-RE2) SP6.198 to permit all uses in the Residential Estate Type 2 (RD-RE2) zone and to allow for the conversion of the existing attached garage to the main dwelling unit, to a second residential dwelling unit, for a total of two residential dwelling units on the subject land.

ANY PERSON may attend the public meeting and/or make written or verbal representation either in support of or in opposition to the proposed Zoning By-law Amendment.

If a person or public body would otherwise have an ability to appeal the decision of Council of the City of Timmins to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of Timmins before the by-law is passed, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the City of Timmins before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

Please note that the rights of third parties to appeal Zoning By-law Amendment decisions to the Ontario Land Tribunal have been restricted under the Planning Act.

The City of Timmins Environmental Services Department wishes to advise the public of Emergency Watermain Break within the following area:

Date and Time of Disruption:
October 28, 2025, from 8:00AM to 4:00PM

Homeowners and businesses within the notification area may experience short-term loss in water pressure or experience brown or rust-coloured water during the disruption. It is recommended not to drink or wash laundry with the discoloured water. While it is not harmful to your health, it can stain laundry. Should this occur, it is advised to turn off your tap for 10-20 minutes in order to allow the crew to finish. Once the work is completed, turn on the COLD water tap closest to the source (usually your laundry tub tap) and let it run for approximately 15-20 minutes or until the water colour has returned to normal.

Environmental Services Department would like to thank residents for their patience and cooperation during this work.

WHEREAS pursuant to City of Timmins By-Law No. 2023-8855 which sets out policies and procedures for the sale and disposition of municipal land.

AND WHEREAS Section 6.0 – Accountability, Transparency and Public Notice Requirements, requires that in considering a sale of City owned land, the land must be declared surplus to the needs and requirements of the municipality and prior to the land sale, notice of the disposition of the surplus lands posted on the City’s website and advertised in the local newspaper for two consecutive weeks. The purpose of such notice is to secure any comments from the public respecting this proposed land sale to be considered by Council so that Council may consider, and if applicable, incorporate into an implementing by-law.

AND WHEREAS the Council for the Corporation of the City of Timmins considers it desirable and expedient that the described land, identified as Mountjoy Concession 2, North Part of Lot 6, Plan 6R-9358, Part 8, part of Parcel 24763 SEC (part of Roll No. 5627-010-092-11500) be declared surplus to the Corporation’s municipal requirements and a portion of the said land be sold directly to 1001139548 Ontario Inc., hereinafter referred to as the purchaser, subject to the following conditions:

That the subject lands be sold for $299,423.39 plus HST. This price includes the land sale price of $298,531.72 and a survey cost of $891.67;

  • That the purchaser acknowledges that the subject land is located within the cost recovery area indicated in Cost Recovery By-law No. 2011-7133 (as amended). As such, prior to a building permit being issued, the purchaser shall pay the cost recovery fee of $167,368.75;
  • That the purchaser acknowledges that there is an irregular-shaped hydro easement, tentatively identified as Part 11 on the draft reference plan, located on the south limit of the subject land and the easement shall be registered on title;
  • That the purchaser shall have two (2) years from closing to complete the proposed development, or the municipality has the option to re-transfer the subject lands back to the municipality for the purchase price of $298,531.72 (plus HST);
  • That the municipality has the right of first refusal to re-acquire the subject land at the original price should the purchaser contemplate the future sale of all or part of the subject land within two (2) years of closing;
  • That all expenses for both the municipality and purchaser related to this land purchase, including but not limited to the legal and registration costs, shall be the responsibility of the purchaser;
  • That the purchaser shall have six (6) months to finalize this land transfer, otherwise this land sale shall be null and void; and
  • That this direct land sale be approved by Council by-law.

NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the City of Timmins does hereby declare the following described land as being surplus to the Corporation’s requirements:

The City of Timmins has completed emergency repairs and clean-out of the primary anaerobic digester at the Mattagami Water Pollution Control Plant from a build-up of solids, rags, and debris. The total cost to date is $1.2 million with more than $2.2 million committed to address immediate infrastructure risks and maintain the treatment process and compliance. No overflows or bypasses occurred as a result of repairs.

The Mattagami Water Pollution Control Plant began experiencing issues with the anaerobic digester in late February due to solids buildup that was blocking the recirculating pumps. Plant operators worked diligently to maintain treatment processes and ensure continued compliance with all effluent limits. The Ministry of the Environment, Conservation and Parks (MECP) was notified immediately, and the City maintained regular communication and weekly updates as repairs were addressed.

“This situation reinforces why we ask residents to only flush human waste and toilet paper,” said Ken Krcel, Director of Public Works and Environmental Services. “No wipes in Pipes. Even wipes labeled ‘flushable’ do not break down like toilet paper. This can cause serious clogs in your home plumbing and in the City’s wastewater system, leading to expensive repairs and backups.”

Work is currently being carried out to commission the primary digester before clean-out begins on secondary digesters. Relining is now planned for both the primary and secondary digesters as part of the 2026 capital budget. The work will ensure the long-term integrity of critical treatment infrastructure and reduce the likelihood of future emergency expenditures.
